The National Energy Regulator of South Africa (Nersa) expects its application for leave to appeal a recent North Gauteng High Court judgment, which found its approval of Eskom’s third multiyear price determination (MYPD3) Regulatory Clearing Account (RCA) for the 2013/14 to be unlawful, to take place in November. Full-time regulator Thembani Bukula reports the leave-to-appeal hearing could take place on either November 2 or 17, with the date for the actual appeal contingent on the outcome of the hearing.
